Cancellation of House Arrest and Most Restrictions on Activist Muhammad Jabareen from Umm al-Fahm

SadaNews - The occupying court in Haifa canceled, today Thursday, most of the restrictions imposed on the political activist Muhammad Taha Jabareen from the city of Umm al-Fahm, after nearly two years of his arrest due to his political activities in violation of freedom of expression.

 

Jabareen's arrest came following his participation in a protest against the genocide committed by Israel in the Gaza Strip on October 19, 2023, following the massacre at the Baptist hospital in Gaza City.

The decision came in response to a request made by the defense team to cancel all the restrictive conditions imposed on Jabareen, including nighttime house arrest, the financial guarantee deposited, the suspended guarantee, and the travel ban.

The defense's request was based on the long period since the restrictions were imposed and the cessation of war, considering that this necessitates reconsideration of the level of danger attributed to Jabareen, especially since the public prosecution has claimed all this time that his case "involves a high risk that warrants the continuation of the restrictions imposed on him."

The court agreed to the request in full except for the travel ban, issuing a decision to cancel all other conditions imposed on him.

The court had imposed strict restrictive conditions on Jabareen in June 2024 after his release from actual detention, including house arrest in the village of Zofit, and later in his home in Umm al-Fahm, requiring him to remain at home during the daytime and be accompanied by a constant person when going out.

The Adalah Center has accompanied this case since its inception, submitting a series of petitions to the court demanding the cancellation of the arbitrary restrictions imposed on him, which has now been achieved by a formal judicial decision, according to a statement released by the center.

For her part, lawyer Hadeel Abu Saleh from the "Adalah" Center, who is representing Jabareen in court, stated: "We commend the court's decision to remove most of the restrictive conditions that turned Muhammad's life into a continuous daily suffering, violated his right to freedom of movement, and restricted his ability to work and live normally, although it has come too late."

Abu Saleh added that the court "should not have imposed any of these conditions in the first place, as the case is political par excellence, targeting an activist who expressed his opposition to the war on Gaza, like many others who are pursued in various ways merely for exercising their right to express opinions and demonstrate."

It is noteworthy that Muhammad Jabareen, who is active in political and social issues, was among the participants in a series of protests that took place in Arab towns against the war on Gaza in October 2023, which faced a crackdown from Israeli authorities against its organizers, resulting in widespread pursuits and arrests of dozens of activists.
