Head of Lawyers: The Supreme Court and the Israeli Judiciary in General Play a Historical Functional Role in Reinforcing and Institutionalizing the Occupation

SadaNews - Palestinian Lawyers Syndicate Head Fadi Abbas stated that the recent decision issued by the Israeli Supreme Court, which legitimizes the occupation's actual control over the Ibrahimi Mosque in Hebron under justifications the court referred to as "regulatory procedures," is additional evidence of the functional role of the Israeli judiciary in institutionalizing the occupation by formulating a new decision in this manner.

The head of the lawyers noted that the judicial system affiliated with the occupation authorities has, for decades, devoted itself to being an integral part of institutionalizing the occupation, with many testimonies and rulings confirming this, starting with the legitimization of land confiscation decisions and the applications of the Custodian of Absentee Property, through the legitimization of demolition orders, among many other judicial decisions and orders.

He added that the dangerous violation of international law practiced by the Supreme Court in its recent decision regarding the Ibrahimi Mosque, including the successive procedures to change the historical character of the site, has not received the necessary attention and spotlight from international organizations regarding the nature of the grave violation of this decision to international law. This requires more joint human rights work at various levels to confront this judicial approach that has established itself to sustain the occupation in successive violations of the provisions and rules of international humanitarian law and the rulings of the International Court of Justice in 2004 regarding the Separation Wall, and in 2024 regarding the consequences of the Israeli occupation on the occupied Palestinian territories.
