
Israeli Government Legal Advisor: An Official Investigation Committee for the October 7 Events is the Legal Mechanism
SadaNews - On Sunday, Israeli government legal advisor Gali Baharav-Miara sent a message to ministers stating that an official investigation committee is the appropriate mechanism to investigate the events of October 7.
Baharav-Miara wrote in her message, prior to the government's discussion on investigating Israeli failures that led to the October 7 attack, that "an official investigation committee is the suitable legal mechanism for investigating the events of October 7 and the 'Iron Swords' war (the war on Gaza). To refrain from making a decision that would impact a future investigation and the possibility of reaching the truth in the investigation."
The Israeli government decided last May to postpone the formation of an investigation committee, although Baharav-Miara urged for a decision on the matter to be made as quickly as possible. At that time, the security-political cabinet decided to expand the war in Gaza, considering that "the time is not suitable for an investigation."
Despite calls for the formation of an official investigation committee, the government is seeking to prevent such a committee from being formed. Instead, it announced that a committee to investigate the October 7 events will be formed in violation of the law, which stipulates that the president of the Supreme Court appoints the chair of the investigation committee, rather than being elected with the support of at least 80 Knesset members.
According to the government's plan, it will decide the mandate to be granted to the investigation committee, as well as the timeline, which would extend for many years before the events of October 7, claiming that it should reach the historical failures that led to the October 7 events, which would benefit Prime Minister Benjamin Netanyahu, as the investigation would be historical and his responsibility for events closer to October 7 would be diminished.
