The President Approved It.. The Most Important Provisions of the New E-Commerce Law in Palestine

SadaNews Economy - Palestinian President Mahmoud Abbas has approved the E-Commerce Law in Palestine, which will come into effect three months after its publication in the official gazette.

The achievement of this law is part of the reform program led by the Palestinian government in organizing the legislative environment governing the national economy, and it crowns the extensive efforts made by the Ministries of National Economy and Communications and Information Technology to regulate e-commerce in Palestine.

Minister of Economy Muhammad Al-Amour stated: "The law is a real leverage for organizing the e-commerce sector, providing a safe and stimulating environment to practice it according to the best international practices, while preserving and protecting the rights of consumers. There will be a series of procedures that ensure the actual implementation of this new law."

The law consists of 28 articles aimed at enhancing consumer confidence in e-commerce, organizing and regulating the sale of products and services electronically, encouraging investment and entrepreneurship in the digital economy and e-commerce, supporting startups, and contributing to achieving sustainable economic development and tax justice to ensure equality between traditional commerce and e-commerce.

Among the most important provisions of the law is the establishment and construction of an electronic register for e-commerce at the Ministry of National Economy, which includes a database of all electronic providers engaged in e-commerce activities within the State of Palestine, and defining the conditions for registration in the e-commerce register.

According to the law, the Ministry of National Economy will undertake the task of monitoring and inspecting electronic stores to ensure compliance with the provisions of this decision and the legislation issued pursuant to it, and to take the necessary measures to achieve that, with the possibility of seeking assistance from any relevant authority.

The law specifies the standards for electronic advertising presented by the electronic provider, ensuring clarity and understandability, determines the stages of the electronic sale process, the terms of the electronic contract, the obligations of the electronic provider, and cases of non-compliance with delivery deadlines, non-conformity of the product or service, and specifies the prohibitions on e-commerce.

The law also defines the site's policy, requiring the electronic provider to prepare a clear and disclosed policy on the electronic store. In addition to specifying delivery methods and payment methods, the Ministry of Economy is tasked with providing communication channels to receive complaints related to the application of the provisions of this decision and the legislation issued pursuant to it.

Regarding the sanctions clause for those who violate the provisions of the draft decision after its approval, it includes the closure of electronic stores and financial fines.
